Article 1

1.1 - Product Description

The product offered is an electronic ferry reservation, which may include an e-ticket depending on the specific route's policy. The client is responsible for complying with all check-in requirements. Refunds are granted at the seller's discretion.

1.2 - Client Responsibilities

By making a reservation, the client waives the right to initiate a credit card dispute against the seller and agrees to compensate the seller for any losses incurred due to such disputes within 15 days. The client also waives any rights afforded under domestic or foreign credit or agency legislation.

1.3 - Non-Refundable Tickets

All reservations are non-refundable unless specifically authorized by the operator. Refund requests must be directly confirmed by the ferry operator.

1.4 - Service Charge on Refunds

Any refund issued is subject to a 20% service charge.

1.5 - Buyer/Passenger Responsibilities

The buyer is responsible for meeting all passport and visa requirements for entry into any port of call. Failure to meet these requirements does not qualify for a refund.

Article 2

These conditions govern the sale of travel tickets via the St Barth Ferry website. A contract is established upon successful payment, and confirmation is sent to the buyer's email. Tickets include relevant port and luggage fees.

Article 3

A contract is realized by delivering a purchase confirmation via email. If electronic payment is incomplete, the purchase is voided. Tickets must be presented in printed form along with identification at the check-in desk.

Article 4

The transport service is provided by the carrier named on the ticket. In the case of multiple carriers, all names will be listed. St Barth Ferry is not liable for damages due to force majeure or events beyond its control.

Article 5

Timetables and prices are updated regularly but cannot be guaranteed. Customers are advised to confirm departure times 12 hours prior to travel. Minor changes and delays may occur, and St Barth Ferry will notify customers of any significant changes.

Article 6

Tickets can be purchased online up to 2 hours before departure, subject to carrier and occupancy conditions.

Article 7

Refunds are possible under specific conditions and must be requested at least 48 hours prior to departure. Non-refundable and non-amendable tickets are clearly marked. Re-booking is possible 24 hours prior to departure.

Article 8

Information on travel ticket prices is available on the website. An online service fee of 20% per ticket applies. Payments can be made using Maestro, MasterCard, or Visa.

St Barth Ferry reserves the right to change these terms according to its business policies and legal obligations.

St Barth Ferry ensures secure internet shopping through D Secure 3.

Article 13

Tickets purchased via partners are subject to the partner's terms and conditions. St Barth Ferry is not liable for cancellations or errors made by partners.

Article 14

Passenger Luggage and Packages – Limitation of Liability. All luggage, personal effects, baggage, parcels, and any other items brought on board by the Passenger travel entirely at the Passenger’s own risk. Go Fast Ferry LLC and StBarthFerry.com shall not be responsible or liable for loss, theft, delay, misdelivery, damage, deterioration, or destruction of any luggage or packages, whether carried by the Passenger, stored in designated areas, placed in cargo holds, or handled by crew members, except where liability cannot be excluded under mandatory applicable law.

Passengers remain solely responsible for the supervision, handling, packing, and security of their luggage and packages at all times, including during embarkation, disembarkation, and transit. No declaration of value shall be accepted, and no special custody or safekeeping agreement shall be implied or created, whether expressly or tacitly.

To the fullest extent permitted under applicable United States maritime law, including general maritime principles, and European Union and French maritime law, including but not limited to Regulation (EU) No 1177/2010 and the French Transport Code, Go Fast Ferry LLC and StBarthFerry.com exclude any liability for indirect, incidental, or consequential damages relating to luggage or packages, including but not limited to loss of use, financial loss, or personal inconvenience.

Nothing in this Article shall exclude or limit liability for death or personal injury resulting from gross negligence or willful misconduct where such exclusion is prohibited by mandatory law. In jurisdictions where limitation of liability is required, any liability shall be limited to the minimum amount prescribed by the applicable maritime conventions, statutes, or regulations.

By purchasing a ticket and boarding the vessel, the Passenger expressly acknowledges and accepts this allocation of risk regarding luggage and packages, in accordance with standard ferry transport practices and maritime transport protocols.
